Terms of Use

1. Eligibility & Account Registration

You must be at least 18 years of age to create an account on eksec. By registering, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms.

When creating an account, you agree to:

• Provide accurate, current, and complete information
• Keep your account credentials secure and not share them with others
• Notify us immediately if you suspect unauthorized access to your account
• Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate any account that provides false information, violates these Terms, or is used in a fraudulent or harmful manner.

2. Listing Rules & Prohibited Content

eksec is a community marketplace. Sellers are responsible for ensuring their listings comply with all applicable laws and these Terms. You may not list:

• Illegal goods or services of any kind
• Stolen, counterfeit, or fraudulently obtained items
• Alcohol, tobacco, controlled substances, or prescription medications
• Weapons, firearms, ammunition, or explosive materials
• Adult or sexually explicit content
• Items that infringe upon intellectual property rights of others
• Live animals
• Listings that are misleading, deceptive, or contain false information
• Services that are illegal under federal, state, or local law

Food sellers are solely responsible for compliance with applicable food safety regulations, permits, and cottage food laws in their state. eksec does not verify, certify, or endorse any food products listed on the Platform.

We reserve the right to remove any listing at our sole discretion without prior notice.

3. Transactions & Payments

eksec is a discovery and connection platform, not a payment processor or escrow service. All transactions — including pricing, payment method, delivery, and fulfillment — are agreed upon directly between buyer and seller.

eksec is not a party to any transaction and assumes no liability for:

• The quality, safety, legality, or authenticity of any item listed
• The accuracy of any listing description or photograph
• The ability of a seller to complete a sale or a buyer to complete a purchase
• Disputes arising from transactions between users
• Loss, damage, or injury resulting from a transaction

4. User Conduct

You agree to use eksec in a manner that is lawful, respectful, and consistent with our community values. You may not:

• Harass, threaten, or abuse any other user
• Post spam, unsolicited messages, or engage in phishing
• Attempt to circumvent, disable, or interfere with the Platform's security features
• Scrape, copy, or systematically extract data from the Platform
• Use automated bots or scripts to access or interact with the Platform
• Impersonate any person or entity
• Create multiple accounts to evade a suspension or ban
• Use the Platform for any commercial purpose beyond buying and selling listed items

Violations of this section may result in immediate suspension or permanent termination of your account.

5. User Content & Intellectual Property

When you upload photos, write descriptions, or post reviews on eksec, you retain ownership of that content. However, by posting content on the Platform you grant eksec a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute that content solely for the purpose of operating the Platform.

You represent and warrant that:

• You own or have the right to post any content you submit
• Your content does not infringe upon any third party's intellectual property rights
• Your content does not contain defamatory, obscene, or unlawful material

eksec and its logo, name, and design are the intellectual property of eksec. You may not use our branding without written permission.

6. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using eksec, you consent to the collection and use of your information as described in the Privacy Policy.

7. Disclaimers & Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. EKSEC DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

TO THE FULLEST EXTENT PERMITTED BY LAW, EKSEC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR ANY TRANSACTION CONDUCTED THROUGH IT, EVEN IF EKSEC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claim arising from use of the Platform shall not exceed fifty dollars ($50.00).

8. Termination

You may close your account at any time by contacting us. We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or pose a risk to other users or the Platform.

Upon termination, your listings will be removed and your data handled in accordance with our Privacy Policy. Provisions of these Terms that by their nature should survive termination — including intellectual property rights, disclaimers, and limitation of liability — will continue to apply.

9. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. We may also notify registered users by email for significant changes. Your continued use of the Platform after any update constitutes your acceptance of the revised Terms.

These Terms are governed by the laws of the United States. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.
